TAPIO ECOSYSTEM
TERMS AND CONDITIONS OF USE FOR THE TAPIO SERVICE "SERVICEBOARD"

  1. GENERAL

    1. The present Terms and Conditions of Use for the tapio service ServiceBoard ("ServiceBoard"), belonging to tapio GmbH, Karl-Berner-Straße 4, 72285 Pfalzgrafenweiler ("we", "us") set out the special terms for the licensing and use of the services we ourselves offer our customers ("customer(s)", "you") via tapio.
    2. ServiceBoard is a service that supports the communication between service partner and customer relating to the services provided by the service partner. The service partner shall be liable for the content of the service case, the video diagnosis and additional functions.
    3. In addition to the present (these) Terms and Conditions of Use, the general terms and conditions of use for the tapio Ecosystem ("Platform Terms and Conditions of Use") agreed between you and us shall also apply, even when this is not explicitly reiterated for each individual topic (e.g. liability, place of jurisdiction). In the case of discrepancies between the provisions of the Platform Terms and Conditions of Use and the provisions of these Terms and Conditions of Use, the provisions of these Terms and Conditions of Use shall take precedence over the Platform Terms and Conditions of Use.

  2. DEFINITIONS
    1. Service partners are tapio partners, their subsidiaries and/or their service providers who, in order to improve their services, use the tapio ServiceBoard as a means of communicating with customers.
    2. To ensure that service cases between the service partner and customer can be processed, service partner relationships must be in place, which are enabled by the service partner at the customer's request.
    3. A service case is established when the designated form, provided through ServiceBoard and duly completed by you, the customer, is sent to the service partner. Depending on the service provided by the service partner, information such as, but not limited to, the following must be specified: the request and the designations of the service objects (e.g. machine number or material batch).
    4. Service objects include machines, materials or tools that are manufactured by the service partners.
  3. REGISTRATION

    To be able to use ServiceBoard, you must be registered on tapio as an authorized service user and have purchased the service. Using services for the machines and systems of third parties (especially through the registration of third-party machines/systems in the admin portal) is expressly prohibited.

  4. INFORMATION REQUIREMENTS

    If you wish to use ServiceBoard, we ask every service user to register by providing their email address and name and by giving their consent for the processing of personal data. The relevant customer administrator can then grant service users the rights to use the service. The service can only be used by entering the access data generated in this process.

  5. SCOPE OF SERVICES

    1. The scope of functions of ServiceBoard is set out in the ServiceBoard product description, which is available to view at the tapio shop (https://store.tapio.one). In addition, the properties and availability of the tapio app shall be subject to the relevant provisions of the Platform Terms and Conditions of Use.
    2. Depending on the services offered by the service partner, the scope of information provided by the service partner can vary. tapio offers no guarantee or warranty for the scope, quality or content of the partner's information or individual features.
    3. ServiceBoard can only be used as an application for mobile operating systems. Specific details can be found in the product description, which is available to view.
    4. The specific scope of use (e.g. maximum number of machines, number of service partners and/or service users) also depends on the services offered by the respective service partner. At the end of the initially agreed period of use, the term shall be automatically extended by the additional term selected at the point of purchase.
    5. In addition, the type, content, scope and limits of the usage right purchased for ServiceBoard are set out in the Platform Terms and Conditions of Use.
  6. DATA USE, DATA PROTECTION

    1. Our policy on data use and data protection can be found under https://www.tapio.one/policy.
    2. In order to enable the service partner to deliver the service, we shall forward the customer information relating to the service case (service case text, including additional information provided by the customer, e.g. product designations such as machine number, product number or similar, as well as any attached media, and any other information if applicable) to the service partner for whom a valid service partner relationship exists. This information shall include the required customer contact details (email, name, telephone number).
    3. In the event that the service partner offers the additional feature of subsequent processing of a service case, we shall provide the service partner with the information you have entered, including your contact details (email, name), and the time of processing.
    4. To display spare parts information in service cases or overviews, information shall be exchanged between the service partner and tapio, e.g. order status, spare parts numbers or spare parts designation.
    5. If you use the video diagnosis option, your image and sound shall also be transmitted to the service partner.
    6. To prepare your service partner for the provision of the service, your machine numbers and the names of the machines shall be communicated to the service partner on a regular basis. This only refers to service partners for whom valid service partner relationships exist and to machines that have been assigned to the ServiceBoard and for which the service partner offers its service.
    7. To ensure that the service runs smoothly, the service partners for whom valid service partner relationships exist shall be informed that the customer is a ServiceBoard user.
  7. FEES

    1. The level of fees payable by the customer shall be determined by the fee model applicable for ServiceBoard and the prices valid at the time of the order.
    2. The service partner may charge the customer an additional fee for the services it provides.
    3. In addition, the fees payable by the customer and the payment terms shall be subject to the provisions of the Platform Terms and Conditions of Use.
  8. RESPONSIBILITY OF THE CUSTOMER

    1. The customer shall be responsible for the provision and maintenance of the required system as specified in the product description and in the Platform Terms and Conditions of Use.
    2. ServiceBoard (for each individual manufacturer) must be purchased for all service objects for which ServiceBoard is intended to be used. In addition, Clause 2 shall apply and ServiceBoard may only be used by authorized service users, who comply with the Platform Terms and Conditions of Use.
    3. It is made clear that the other provisions of the Platform Terms and Conditions of Use regarding the customer's responsibilities and duties of cooperation also apply, in particular concerning the use of the tapio app and the interpretation and usage of the data/information which the customer can access via the app.
  9. TERM, TERMINATION

    1. Unless otherwise explicitly specified in the product description, ServiceBoard cannot be terminated before the end of the initially agreed term. The customer shall be entitled to terminate the service no later than three days prior to the end of each term that has been automatically extended. The notice of termination shall be submitted at https://administration.tapio.one using the designated function.
    2. The other provisions of the Platform Terms and Conditions of Use, including the right to early extraordinary termination for good cause shall remain unaffected.
  10. OTHER PROVISIONS

    1. These Terms and Conditions of Use, together with the product description including price information, available at https://store.tapio.one, and the Platform Terms and Conditions of Use, which are available separately, shall constitute the entire agreement between us and the customer for the tapio app ordered.
    2. The general purchasing or other terms and conditions of the customer shall not apply.
    3. If ServiceBoard contains spare-parts or other product information stored by a tapio partner, tapio shall not assume any liability for the accuracy of such data. Any claims and demands shall be addressed to the partner.
